Prior to CGWG undertaking representation, a business was selected for an I-9 Audit by U.S. Immigration and Customs Enforcement (ICE), which has significantly increased sweeping investigations across the country. During its investigation, ICE determined that the business failed to substantially comply with I-9 Form requirements and initially assessed a significant fine against the business as a penalty for its alleged non-compliance. After the business engaged CGWG, attorney George Ernst successfully argued for and ultimately secured a 56% reduction in the initial fine. Given the current administration’s keen focus on Form I-9 enforcement, as well as the government’s recent focus on issuing civil and criminal penalties, businesses now more than ever should engage counsel to help prevent and correct I-9 violations by conducting confidential I-9 Audits and HR training. If your business has not conducted an internal, attorney-driven Form I-9 Audit in 2018, and if your hiring managers and HR teams have not undergone recent I-9 training, contact one of CGWG’s Immigration Section attorneys to discuss how we can help with this critical risk management process.
